New appeals against the property tax to be collected through the PPC
bills have been submitted to the State Council (StE), this time by ADEDY
and the Pilea-Chortiatis municipality.
Appeals on the same subject have also been submitted by the Bar Associations of Athens, Kalamata, Thessaloniki, Volos, Heraklion, Syros and Kavala.
The Regional Union of Municipalities of the Peloponnese, the Chamber of Kavala, the “Greek Taxpayers” association and two lawyers have also appealed. Appeals will be discussed in the StE plenary on December 2nd 2011, with the relevant motion brought forward by State Councelor Evangelia Nika.
All seek the annulment of the decision of the Deputy Minister of Finance (issued under the authority of Law 4021/2011), which outlines the process of collecting the temporary special duty.
The main argument is that the 'hike' is not a specific charge, but a new tax, which is contrary to the Constitution and the European Convention on Human Rights (ECHR) which protects property.
In the ADEDY application, it argues that it has as an interest in challenging the StE to issue a decree, and its purpose is to defend the economic interests of its members.

The Municipality of Pilea - Chortiatis has put forth the same argument in its application, and also says that the imposition of the fee is limiting the property of the municipality residents.
